Domestic Relations Financial Disclosure (AOC-239.1)

Required from both spouses in every dissolution case. Discloses:

  • Monthly income from all sources
  • Monthly expenses
  • All assets (real property, vehicles, financial accounts, retirement, personal property)
  • All liabilities (mortgages, loans, credit cards)

Both spouses sign the Financial Disclosure under penalty of perjury. File with the court.


Separation Agreement

Kentucky requires that property, debt, and support issues be resolved by a Separation Agreement in uncontested cases. The Separation Agreement is filed with the court and incorporated into the Decree.

The Separation Agreement must address:

  • All marital property: real estate, vehicles, financial accounts, retirement, personal property
  • All marital debts: assignment to each spouse; indemnification
  • Maintenance (alimony): award, waiver, or reservation
  • If children: legal custody, physical custody, visitation, child support (must comply with Guidelines)
  • Name restoration if requested

Format: No official AOC form for the Separation Agreement — parties draft their own or use legal aid templates. File with the Circuit Court.
