Michigan Divorce Forms — What You Need and Where to Get Them (2026)

Michigan uses standardized SCAO (State Court Administrative Office) forms. All official forms are available free at courts.michigan.gov — click "Forms" and search by form number or "divorce."

Important: Some counties have local supplemental forms. Check with your county's Circuit Court Clerk for any required local forms in addition to the standard SCAO forms listed below.


Core Forms: All Cases

DC 100 — Summons

Issued by the Clerk — not filled out by you After you file the Complaint, the Clerk stamps and issues the Summons. This is the document that formally notifies your spouse they have been sued. You serve the Summons together with the Complaint.

Judgment of Divorce

The final court order that ends the marriage. The Judgment is signed by the judge at the final hearing. In an uncontested divorce, you (or both parties together) prepare and submit a proposed Judgment incorporating your Settlement Agreement terms. Some counties have a local Judgment template — ask the Clerk.


Forms: Cases Without Minor Children

DC 100a — Complaint for Divorce (No Minor Children)

The primary filing document when there are no minor children. Contains:

  • Your name and your spouse's name
  • County and state residency information
  • Date of marriage
  • Statement that the marriage has broken down
  • Any request to restore a former name

Complete carefully. Mistakes in the Complaint can slow down the case. If you want your former name restored, check the name restoration box and specify the name.


Forms: Cases With Minor Children

DC 100c — Complaint for Divorce (With Minor Children)

Used when the parties have minor children together. Includes all the information from DC 100a plus:

  • Names and dates of birth of all minor children
  • Current custody/residence information
  • Statement about prior custody orders

Friend of the Court (FOC) Forms

When minor children are involved, the FOC requires additional documentation. Required forms vary by county. Common FOC forms include:

Always ask the Clerk's office and the FOC office which forms they require at filing in your county. FOC requirements vary by county.

Child Support Worksheet

You must complete a Michigan Child Support Formula worksheet showing how the guideline support amount was calculated. Both parties' incomes and the number of children are required. The FOC will independently calculate support, but having your calculation ready demonstrates you've followed the formula.

Service Forms

DC 108 — Acknowledgment of Service

If your spouse is cooperative, they can sign this form confirming they received the Complaint and Summons. Once signed and filed with the Clerk, it functions as proof of service. This is the fastest and cheapest service method.

Proof of Service (Affidavit of Service)

After serving via sheriff or process server, the server completes and files an Affidavit of Service confirming delivery. If you served by certified mail, file the signed return receipt card as proof.


Settlement Agreement / Consent Judgment

Not a standard SCAO form — this is a document you and your spouse draft (or an attorney drafts) that sets out all agreed terms:

  • Division of all property and debt
  • Real estate disposition
  • Retirement account division
  • Vehicle assignments
  • Spousal support (amount, duration, or mutual waiver)
  • Custody (legal and physical) — cases with children
  • Parenting time schedule — cases with children
  • Child support amount — cases with children
  • Health insurance for children — cases with children

Both parties sign the Settlement Agreement. It is attached to or incorporated into the Judgment of Divorce.

Post-Divorce Forms

QDRO — Qualified Domestic Relations Order

Required to divide employer-sponsored retirement plans (401k, 403b, pension). A QDRO is a separate court order — not a SCAO form — typically prepared by an attorney or QDRO specialist. Cost: $400–$1,500. Filed with the plan administrator after the divorce.

Deed Transfer

To transfer real estate title after divorce, a new deed must be prepared (usually a Warranty Deed or Quitclaim Deed), signed, notarized, and recorded with the county Register of Deeds. This is not part of the divorce court process — it is a real estate transaction that happens after the Judgment.

Vehicle Title Transfer

Michigan Secretary of State handles vehicle title transfers. Bring the signed title and a certified copy of the Judgment to any Secretary of State branch office.
